General rental conditions

1. Generalities


The lessee acknowledges having read these general terms and conditions. AGV Invest, trading as 'VacationHost', may unilaterally amend these terms and conditions at any time. All changes, unless expressly stated otherwise by VacationHost, will apply immediately when they appear on the Web site. The hirer/customer is responsible for being aware of these latest published terms and conditions. Use of VacationHost's services and payment of a deposit implies that the customer is bound by these terms and conditions.


2. Booking


When booking, the customer must clearly
- state the exact name of the participant(s) and their ages
- state whether he is accompanied by an animal, for which he must obtain express permission in the stated rental conditions
- if he is coming with an electric vehicle. Separate rules sometimes apply to this.

By the payment of the renter(s), he/she indicates his/her agreement with the general conditions mentioned on our website. Both for domestic and foreign payments, the general bank charges are borne by the tenant. The booking is confirmed as soon as the deposit of 50% is paid. The remaining payment is made 30 days before arrival.


3. Price-payment


After booking, no disputes concerning the price of the accommodation will be accepted. In addition to the 50% deposit, VacationHost will charge a fixed administration fee of 35.00 EUR for each rental agreement it enters into. In the event of a rebooking, this administration fee is not transferable and will therefore be charged again.

Tourist tax: Since 2019, the payment of tourist taxes is required by law in most regions in Belgium, Spain and France. This is a tax paid by tenants when renting a vacation home. The tourist tax is calculated using official rates on the number of nights per person over the age of 18. Every year the new tourist tax is voted by the relevant authorities for each region. There is a possibility that tourist taxes may change and then we are obliged to apply the new tourist tax. Should there be a price change, the tenant will be informed and will receive an updated rental agreement. Any price changes are always small.


4. Guarantee


The rental of a vacation home implies the possible payment of a deposit, the conditions of application of which are laid down in the stated rental conditions. The deposit is paid by bank transfer before arrival or on site upon arrival (see conditions of the property). The deposit will be refunded within 2 weeks after your return and this after the proper and complete fulfillment of all your rental obligations have been determined by the landlord's representative. The tenant is obliged to leave the rented property in a good and clean condition, i.e. everything is back in its original place both inside and outside, the kitchen is completely cleaned (fridge, oven and other appliances have been cleaned and all dishes are in their place), all waste and garbage has been taken away. If this is not the case, fees may be charged.

The maximum number of persons may not be exceeded without prior authorization from VacationHost. If this is the case, the accommodation may be refused or the deposit may be collected in full immediately.


5. Cancellations


Any cancellation must be communicated to VacationHost by e-mail and proof of receipt. The date of receipt serves as proof and makes it possible to determine the amount of the cancellation fee (unless otherwise specified in the accommodation information):
- Cancellation more than 60 days before the occupancy of the rented accommodation : only the administration fee unless otherwise specified in the accommodation information
- cancellation between 60 and 30 days : 50% of the total rental price
- cancellation less than 30 days before the occupancy of the rented housing : 100% of the total rental price.
It goes without saying that the administration fee and any insurance will not be refunded.

Remark:
For cancellations due to atomic and nuclear accidents, radiations, epidemics, fires, wars or other external cases of force majeure, the amount already paid by the customer will be refunded by VacationHost with the administration fee deducted.


6. Obligations VacationHost


- By virtue of an express or implied mandate, VacationHost acts in all circumstances as an intermediary between the lessee and the lessor.
- If the leased property is not available independently of VacationHost undertakes to ensure that the lessee obtains accommodation of the same capacity and price range as far as possible.
- VacationHost cannot be equated with a transportation company, nor can VacationHost be held liable for any accidental damage (including theft) that may occur during the performance of the hirer's obligations.
- In no event can VacationHost be held liable if, on the date of reservation, it is not notified by the owner of changes to the leased property or its immediate surroundings, or if the changes occur between the time of reservation and the time the customer occupies the leased property.


7. Obligations of the renter


- The tenant must communicate the correct number of participants. If there are too many, the local correspondent has the right to refuse entry to the accommodation or a portion of the deposit will be collected.
- Animals will only be allowed if VacationHost expressly agrees. Failure to do so may result in part of the deposit being collected.
- The dates and hours of stay must be very strictly observed. If the accommodation is not occupied on the agreed date or in case of late arrival, the tenant must inform the local correspondent. If the hour of departure (see conditions check-out) is not respected, part of the deposit may be collected to hire additional workers for cleaning.
- Throughout the duration of the stay, the tenant is fully responsible for the property. He undertakes to cover the costs resulting from any fault or negligence on his part or on the part of the other occupants.
- The tenant will treat the property as a good housekeeper and will maintain the property. The tenant also has the necessary insurance against rental risks such as fire, water damage and others.
- The furniture and movable objects that are missing or out of use after the expiration of the rental must be paid for or replaced by the tenant, with the agreement of the local correspondent.
- The property must be left in an impeccable state of cleanliness. The renter is obliged to leave the rented property in a good and clean condition, i.e. everything is back in its original place both inside and outside, the kitchen is completely cleaned up (refrigerator, all appliances and its oven cleaned and all dishes are in their place), all trash and garbage has been taken away. If this is not the case, the full deposit will be collected. Each vacation rental has an on-site trustee, whose on-site findings are always taken seriously.
- The lessee relieves the owner and VacationHost of all responsibility for any accidents that may occur in the vacation rental, the garden, as well as in and around a swimming pool.


8. Miscellaneous


- The renter acknowledges that he has read the description.
- The renter must immediately inform the local correspondent or VacationHost of any discrepancy concerning the furnishings or other matters of the rented accommodation. This complaint must be made within 48 hours of moving into the accommodation. If this is not done, subsequent complaints cannot be taken into consideration.
- The local correspondent legally represents VacationHost and must remedy any discrepancy, insofar as it seriously affects the rights of the renter.
- Any complaints relating to the rented property but not to the furnishings must be communicated directly to co-contractors by e-mail within 48 hours of occupying the property. After the expiration of this period, no complaints can be considered.
- If on arrival the property is not clean or tidy, this must be reported immediately to the person in charge. Additional cleaning may then be provided. If this is not reported immediately, subsequent complaints about the cleanliness of the property cannot be accepted.
- The tenant who refuses to take possession of the property - because in his opinion it does not appear to meet his expectations - and wishes to have his rent refunded, must be able to produce a bailiff's writ confirming that the leased property is uninhabitable.
- VacationHost is not liable for unforeseen events, cases of force majeure or nuisances that disturb, interrupt or prevent the stay. Under no circumstances can they give rise to the payment of compensation.
VacationHost is not liable for accidents that may occur in and around the vacation rental pool. Prices during the low season are always much lower than prices during the middle and high seasons. Due to unpredictable weather conditions, the temperature of the water in the pools may be too low for bathing. Due to bad weather conditions in spring or fall, sometimes the pools may not be usable. VacationHost cannot be held at fault for this. Therefore, lower rental rates are applied.
VacationHost is never responsible for local problems with the Internet.


9. Disputes


Only the courts of Brugge have jurisdiction for all disputes that may arise from the interpretation, observance or application of this contract. In all cases, the amount of any legal claim can never exceed the rental price stated on the contract.
